Definition and Scope

Chapter 37 of the Government Code would define a meme coin as any digital asset whose primary marketing or recognition rests on internet memes, public figures, fictional characters, current events, shared humor, celebrities, or social trends and whose value comes chiefly from speculation or community engagement. Issuance means making the asset available for public purchase, donation, or exchange.

Ownership Restrictions

Section 7599.211(a) would bar any public officer or public employee from issuing a meme coin. Section 7599.211(b) would prevent digital asset service providers from listing for California residents any official-tied meme coin issued on or after January 1, 2027. The attorney general, district attorneys, city attorneys, and county counsel could seek only civil remedies of injunction and disgorgement. Private issuers and tokens not tied to public officials remain outside the scope.

Utility Lens

The language targets conflicts that arise when public officials control issuance. For holders it preserves the distinction between official promotional activity and community-driven collections whose utility flows from on-chain ownership and shared culture rather than any officeholder stake. The bill does not reach existing majors or tokens already in circulation that lack official issuance ties.
